RentPlanet Apartment Rental Regulations 

§ 1. General Provisions 

  1. These Regulations specify: 
    • the rights and obligations of the Customer, hereinafter referred to as “Guest” and of the Service Provider – RentPlanet Apartments Sp. z o. o., ul. Powstańców Śląskich 7A, 53-332 Wrocław, entered into the register maintained by the District Court for Wroclaw-Fabryczna in Wroclaw, 6th Commercial Division, National Court Register No. (KRS): 0000658841, Tax ID No. (NIP): 5223081618, Statistical ID No. (REGON): 366364260, hereinafter referred to as “RentPlanet Apartments”, concerning rental of apartments offered by RentPlanet Apartments, as well as payments, complaints and responsibilities. 
    • the conditions for reservation of premises on the internet portal available at https://noclegi.rentplanet.pl/, hereinafter referred to as the “Website”, as well as payments, complaints and responsibilities. 
  1. The Regulations are an integral part of the Agreement which is signed upon reservation and/or upon making an advance payment or full payment for the stay at RentPlanet Apartments premises. By performing the aforementioned actions, the Guest confirms that they have read and accept the Regulations available at:  https://noclegi.rentplanet/en/rental-regulations/
  1. Through the Website, RentPlanet provides services facilitating conclusion of short-term agreements for the rental of rooms and apartments (hereinafter “Apartments”). 
  1. RentPlanet Apartments is obliged to deliver the ordered services and goods free from defects. 
  1. Correspondence with RentPlanet may be directed by e-mail to the address biuro@rentplanet.pl. 
  1. Phone contact with RentPlanet is possible at the following number: +48 71 755 01 50. 
  1. The Guest is obliged to follow these Regulations and make timely payments arising from the concluded Agreements. 
  1. The rights and obligations of the parties concerning the protection of personal data and the information about cookies are regulated by the Privacy Policy, available at: https://noclegi.rentplanet/en/privacy-policy-of-the-website/

§ 2. Provisions of the Agreement 

  1. The subject matter of the Agreement is the rental of an Apartment offered through the Website or on other booking websites serving as intermediaries between the Guest and RentPlanet Apartments (hereinafter: “Other Portals”) and all the mutual rights and obligations of the Guests and RentPlanet Apartments arising from the Agreement. 
  2. RentPlanet Apartments is obliged to provide guests with premises consistent with the description contained on the Website or Other Portals when concluding the Agreement and within the dates specified in the reservation, and the Guest is obliged to pay the price indicated during the booking process and to observe the rules of using the premises as well as the common parts of the building and adjacent green areas. Depending on the Guest’s choice made on the Website or Other Portals, the price for the stay may or may not include the price for servicing the Guest’s stay (including cleaning); however, the components of the final price are always clearly indicated on the Website or Other Portals, and include all amounts due arising from the concluded Agreement. 
  3. Making a reservation by the Guest through the Website or Other Portals constitutes the acceptance of these Regulations and the conclusion of the Agreement. 

§ 3. Reservations and Rules of Payment 

  1. The Guest may book Apartments for stays at prices and within dates specified on the Website or Other Portals, using the Website or Other Portals, via e-mail, by phone, or with the help of a RentPlanet Apartments representative. 
  1. Booking a stay via the Website requires computer equipment, or other electronic equipment with similar capabilities, compliant with the following technical requirements: 
    • access to the Internet, 
    • an installed web browser (it is recommended to have the most up-to-date browser version, e.g. Internet Explorer, Google Chrome, Mozilla Firefox, Safari, etc.), 
    • an active and correctly configured e-mail account
  1.  In the booking process, the Guest selects the Apartment using the Website or Other Portals, and then books the Apartment by completing a virtual booking form available on the Website or Other Portals. If the reservation is made with the help of a RentPlanet Apartments representative, the Guest provides data as indicated by the representative. 
  1. The Guest makes the reservation on the Website or Other Portals by specifying a precise starting date of the stay and a precise end date of the stay. The stay is calculated in days. 
  1. Each of the offered Apartments is intended to be used by no more than the number of persons specified in the Apartment’s offer and/or the virtual booking form. 
  1. The number of persons intended to stay in the Apartment is indicated by the Guest during the booking process in the virtual booking form. This number must not exceed the maximum number intended for the Apartment. A stay of a higher number of persons than indicated in the booking form, and lower than the maximum number intended for the Apartment, must be agreed directly with RentPlanet Apartments before the start of the stay and may result in an increase in the price of the stay or a reservation refusal. 
  1. During the booking process, the Guest is obliged to provide information which is necessary to book the Apartment (in particular, their full name, address of residence, contact phone number, e-mail address), and thus to declare the accuracy thereof. 
  1. During the booking process, the Guest is obliged to make the reservation fee payment. The payment may be made:  
    • via wire transfer or online transfer in accordance with the conditions indicated in the virtual booking form, to the bank account number indicated in the virtual booking form;  
    • by payment card, by using the online payment link or by authorizing the payment by card;  
    • by cash upon check-in, after prior arrangement with RentPlanet Apartments or by indicating this form of payment in the virtual booking form.  
  1. The reservation fee is not lower than the price for one night, and not higher than 100% of the price for the whole stay, depending on the choice of offer and on the selected Apartment.   
  1. Upon reservation and crediting the reservation fee to the account of RentPlanet Apartments, the Guest will receive a booking confirmation from RentPlanet to the specified e-mail address. The booking confirmation contains booking acceptance, offer summary, price of the stay, payment status, acceptance of the Regulations’ provisions, and booking date. 
  1. After making a reservation and before checking in, the guest is obliged to complete and sign the digital registration card. The link to the digital registration card is sent to the guest via e-mail and/or SMS and/or messages using the mobile WhatsApp application. Failure to complete the registration card may result in refusal to check in to the apartment. 
  1. Lack of the payment referred to in § 3 item 8 above within 24 hours from the date of the reservation, entitles RentPlanet Apartments to withdraw from the Agreement without the need to specify an additional date for service provision.  
  1. In a situation where the Guest has paid the price for the stay via bank transfer to RentPlanet Apartments on the day immediately preceding the start of their stay, at the request of RentPlanet Apartments, the Guest is obliged to present a confirmation thereof in any form (including printout or a .pdf file) and on any medium (including paper, smartphone or laptop). RentPlanet Apartments may refuse to accept the submitted transfer confirmation in the event of any suspicion as to its veracity. 
  1. Payment of the reservation fee takes place on the date of crediting it to the bank account of RentPlanet Apartments. 
  1. A successful booking constitutes the conclusion of the Agreement and entering into a rental agreement for a limited period of time. 
  1. The condition for making a reservation is the acceptance of these Regulations, including the conditions for the use of the Apartments, common parts of the building and adjacent areas. The condition for making a reservation may also be the acceptance of additional rules regarding a specific Apartment, presented to the Guest when making a reservation on the Website or Other Portals. 
  1. The reservation price does not include insurance. 
  1. The Agreements concluded through the Website constitute exclusively accommodation services provision agreements, which are different than those for residential purposes. Pursuant to Article 38.12 of the Consumer Rights Act (Journal of Laws of 2014, item 827, as amended), in respect of such agreements, the consumer does not have the right to withdraw from the agreement within 14 days. 
  1. In connection with tax regulations resulting from the Act of 4 July 2019 amending the Act on tax on goods and services and some other acts, and in accordance with Article 1.21 and 1.24, a new obligation is imposed on the recipient of the service (Guest). At the time of recording the sale by the service provider (RentPlanet Apartments), the recipient (Guest) is required to specify whether they act as a consumer (and receive a receipt or an invoice to their name) or as an entrepreneur (and receive a receipt with a tax identification number or a sales invoice to their business). Upon conclusion of the Agreement, the purchaser of the service (Guest) is obliged to notify the service provider (RentPlanet Apartments) of the need to settle the sale as an entrepreneur and to issue a sales invoice. If such information is not provided within 24 hours from the time of booking, the sale will be recorded at the cash register and the Guest will receive a receipt for a natural person, not an invoice to their business. After registering the sale in accordance with the information available upon conclusion of the Agreement, it is not possible to change the fiscal document at a later date. 
  1. RentPlanet Apartments may collect a refundable deposit from the Guests to secure any damages to the Apartment. The amount of the refundable deposit is up to PLN 2,000 and depends on the selected Apartment, the number of Guests and the duration of stay. 
  1. The deposit mentioned in § 3 item 19 above is refunded to the Guests within 7 days from the day of check-out by releasing the blocked fee on the payment card or by wire transfer. If RentPlanet Apartments discovers damage to the Apartment, common parts of the building or adjacent areas that were not recorded upon check-in, the returned deposit will be decreased by an amount equal to the costs of repairing the damage. The above does not prohibit RentPlanet Apartments from seeking compensation in line with the general principles. 

§ 4. Reservation Cancellation 

  1. RentPlanet Apartments and the Guests have the right to withdraw from the Agreement within 3 days from the date of the occurrence of Force Majeure, understood as any inevitable external phenomenon which could not be predicted or opposed to, in particular a factual, legal or administrative phenomenon, which in spite of best efforts could not be predicted, e.g. flood, hurricane, earth quake, storm, snowstorm, war, uprising, revolution, riot. The Covid-19 epidemic is not considered Force Majeure. Force Majeure cannot be understood as: an illness, a car accident, a cancelled flight or train journey, a cancelled time off work, lack of documents authorising to cross the border, family and personal affairs, etc.  In the event of Force Majeure, guests are entitled to a refund of all reservation fees paid. 
  1. The Guest has the right to cancel the reservation for any reason, after receiving the reservation confirmation from RentPlanet Apartments by electronic means, on principles specified in the booking terms and conditions and reservation cancellation conditions of a given Apartment. As a consequence of a reservation cancellation, the Guest will receive from RentPlanet Apartments to the specified e-mail address a confirmation that the reservation of the Apartment was cancelled, and up to 100% of the paid reservation fee, pursuant to the booking terms and conditions, to the account from which RentPlanet Apartments received the payment of the reservation fee. For certain Apartments, the Guest may be obliged to cover the costs of stay cancellation up to the amount constituting the actual loss of RentPlanet Apartments arising from the Guest’s cancellation of the stay. The information on the reservation cancellation and its costs is included in the booking terms and conditions for each Apartment and in the virtual booking form. 
  1. Changing the reservation dates or changing the Apartment selected during the booking process is possible only through the Website or Other Portals, depending on the availability of the Apartment. 
  1. If RentPlanet Apartments, for reasons beyond its control, is forced to amend important conditions of the Agreement before the start of the Guest’s stay, in particular change the booked Apartment or the reservation dates, RentPlanet Apartments immediately notifies the Guest about it, and the Guest should immediately inform RentPlanet if: 
    • the Guest accepts the proposed amendment of the Agreement, or 
    • the Guest withdraws from the Agreement, which is connected with an immediate refund of all the paid fees to the Guest. 
  1. The Guest has the right to apply for a refund of the funds collected for unused stay (in accordance with the booking terms and conditions) within 14 days from the withdrawal from the service or the acceptance of the Guest’s complaint by RentPlanet Apartments. 
  1. RentPlanet Apartments will refund the funds to the Guest if: 
    • cancellation of the booking by the Guest or a no-show resulted solely due to Force Majeure – in this case, all or part of the reservation fee will be refunded, depending on the booking terms and conditions of the intermediary portal and fees for additional services, 
    • the Guest’s complaint is recognized by RentPlanet Apartments. 
  1. RentPlanet Apartments refunds the amount due only by using the payment method used by the Guest when making the booking. 
  1. If a VAT invoice is to be issued, RentPlanet Apartments will inform the customer about the planned refund via e-mail sent to the address provided by the Guest during the booking process. The Guest has 14 days to accept the conditions. Upon receipt of the Guest’s acceptance, RentPlanet Apartments will immediately refund the amount and forward a correcting invoice to the e-mail address provided by the Guest.

§ 5. Terms and Conditions of Stay 

  1. Stay at the Apartment is possible from 4:00 PM (16:00) on the first day indicated in the Agreement. 
  1. The Guest may check in at the Apartment before 4:00 PM (16:00) only upon prior notification and agreement of RentPlanet Apartments. In such a case, RentPlanet Apartments will charge the Guest an additional fee of no less than PLN 50. 
  1. The Guest is provided with keys and/or access codes to the Apartment entrance. The method of handing over the keys and/or access codes to the Guest is described in the booking conditions for each Apartment. Depending on the selected Apartment, keys and/or access codes to the entrance may be handed over to the Guest:  
    • by RentPlanet Apartments at the Apartment address;  
    • by RentPlanet Apartments at a different address;  
    • by e-mail or phone to the Guest’s contact information provided upon reservation.  
  1. On the day of check-in RentPlanet Apartments is entitled to request the Guest to show their valid ID in order to write down the Guest’s personal data. In the event of refusal to present a valid ID, a representative of RentPlanet Apartments has the right and obligation to refuse to allow the Guest to enter the Apartment.  
  1. The stay in the Apartment ends at 11:00 AM on the last day. The Guest is obliged to empty the Apartment of their belongings, leave it and return the keys by this time. 
  1. Leaving the Apartment after 11:00 AM, on the last day of stay, is possible only after prior agreement with RentPlanet Apartments and obtaining consent from RentPlanet Apartments. In this case, RentPlanet Apartments will charge the Guest an additional fee of minimum PLN 50. However, leaving the Apartment must in any case occur no later than at 1:00 PM (13:00) on the last day of stay. If the Guest leaves the Apartment after 11:00 AM on the last day of stay, without the consent of RentPlanet Apartments, RentPlanet Apartments will charge the Guest an additional fee in the amount of the price for one day of renting the Apartment, corresponding to the price for the next day.  
  1. Failure to appear by 8:00 PM (20:00) on the day of arrival is tantamount to resignation from the stay and the possibility of renting the premises to another Guest, if the Guest did not previously inform RentPlanet Apartments of the delay. In this case, the payment towards the booking is refunded by RentPlanet Apartments, in accordance with the booking conditions. 
  1. Quiet hours in the Apartment are from 10:00PM (22:00) to 6:00 AM. 
  1. Persons not declared as Guests when making the reservation may stay in the Apartment between 7:00 AM and 10:00 PM (22:00). Staying of unreported persons in the Apartment outside of the hours indicated above will be treated as a breach of the Agreement.  In this case, RentPlanet Apartments has the right to charge the Guest additional fees for the stay of unreported persons. 
  1. The Guest is obliged to use the Apartment, common parts of the building and adjacent areas in a manner consistent with their intended use, the provisions of the Regulations and the rules of social coexistence, in particular in a way that does not disturb the peace of third parties, including persons residing in neighbouring Apartments. 
  1. RentPlanet Apartments has the right to terminate the Agreement with immediate effect if the Guest or persons staying in the Apartment behave in an aggressive manner, disturb the peace of third parties, including persons residing in neighboring Apartments or other premises within the building, or notoriously violate the provisions of these Regulations. 
  1. In the event of obtaining information specified in § 5 items 9-11 above, RentPlanet Apartments is entitled to call the appropriate public services to the Apartment in order to  investigate the circumstances. RentPlanet Apartments reserves the right to collect a financial penalty of PLN 500 from the Guest if, as a result of the Guest’s behavior, the police or municipal police or fire brigade are called to the Apartment. Notwithstanding the foregoing, any additional costs arising from summoning the competent services are borne by the Guest. 
  1. In Apartments offered by RentPlanet Apartments, common parts of the buildings and adjacent areas, i.e. staircase, elevator, corridors, reception and green areas, smoking is strictly forbidden, in particular of tobacco products and electronic cigarettes. This ban does not apply to  lighting a fire in a fireplace adapted for this purpose, if the Apartment has such a fireplace. 
  1. The Guest and persons who stay with them in the Apartment, common parts of the building or adjacent areas are obliged to comply with the fire safety instructions made available in the Apartment or in the building. For fire safety reasons, it is forbidden to use heaters, electric irons and other similar devices not being part of the Apartment’s equipment in the Apartments. 
  1. In the event of a breach of the prohibition set out in § 5 items 13-14 above, RentPlanet Apartments imposes a fee of minimum PLN 200 on the Guest for each noticed violation, which does not limit the possibility of seeking compensation on general principles (exceeding the amount of contractual penalties).  
  1. RentPlanet reserves the right to refuse serving a Guest who: 
    • does not have a valid ID or does not want to show an identification document, 
    • is under the influence of alcohol or other intoxicants, 
    • grossly violated these Regulations during their previous stay. 
  1. The Guest is obliged to take care of the Apartment, common parts of the building and adjacent areas with due diligence. In particular, the Guest is obliged to close the entrance door of the Apartment during their absence, to close the entrance door and entrance gates to the building and adjacent areas, as well as to not to take equipment from the Apartment or common parts of the building out of the area. 
  1. RentPlanet Apartments reserves the right to charge the Guest a penalty of PLN 200-1,000 for every place left by the Guest of the Apartment in a state different from the one the Guest encountered upon check-in. It might be, among others, flooded and sticky floor, trash lying around, dirty and/or damaged walls/furniture/mattresses/sofas/beds/equipment, present vomit/feces/blood stains, as well as littering, soiling, damaging and leaving cigarette ends in the Apartment or common parts of the building, including adjacent areas.  RentPlanet Apartments also has the right to collect a financial penalty from the Guest if the Guest or unreported persons staying with the Guest commit the following acts in the Apartment, common parts of the building or adjacent areas: 
    • drinking alcohol, in particular in the common areas of the building or adjacent areas that are not designated for this purpose, 
    • unjustified use of fire-fighting equipment, 
    • switching off, painting over, covering, disconnecting or damaging the monitoring system, intercoms or other protective devices. 
    • damaging common parts, including passenger and car elevators. 
  1. The Guest is obliged to report all faults present in the Apartment to RentPlanet Apartments at the e-mail address: biuro@rentplanet.pl. In the case of an unjustified intervention of a RentPlanet Apartments employee in the Apartment upon the Guest’s request (i.e. lack of fault, failure to familiarize themselves with the instruction manual for a device, etc.), RentPlanet Apartments reserves the right to charge the Guest a financial penalty of PLN 100. 
  1. RentPlanet Apartments should ensure that the Apartment is in a condition suitable for the agreed use and keep it in this condition for the duration of the Guest’s stay. The Guest should return the Apartment in a non-deteriorated condition and keep it in this condition for the duration of the stay. Small costs connected with the usual use of the Apartment are borne by RentPlanet Apartments. 
  1. RentPlanet Apartments is not responsible for unintentional interruptions in the supply of utilities and is not liable in the event of any damage to the Guest (or persons staying with him in the Apartment) caused by an interruption in the supply of utilities. 
  1. RentPlanet Apartments retains the right to enter the Apartment in the event of an emergency, which includes, in particular, receiving information about a fire, flooding, burglary or other threat to life, health or property. In the event of receiving information about an emergency, RentPlanet Apartments will immediately inform the Guest about the need to enter the Apartment. 
  1. The apartment is prepared for the maximum number of guests specified in the offer. Additional bedding and towels may be available upon request. Use of such additional items is subject to a fee of PLN 50 per set of bedding or towels. 

§ 6. Responsibility and Complaints 

  1. RentPlanet Apartments is responsible for non-performance or improper performance of the Agreement, unless the non-performance or improper performance is caused solely by the action or omission of the Guest or undeclared persons staying with the Guest or is caused by force majeure situations. 
  1. The Guest is responsible for all types of damages arising in the Apartment, common parts of the building or adjacent areas, in particular in their equipment and permanent elements, caused by the Guest’s action / omission or the action / omission of persons who stayed in the Apartment during the Guest’s stay. The Guest informs RentPlanet Apartments about the aforementioned damages within 7 days of their occurrence. RentPlanet Apartments reserves the right to charge the Guest additional debt collection costs if the due payment is not made voluntarily within the specified deadline. These costs may include, among others, administrative fees, correspondence costs, payment reminders, and other actions aimed at recovering the outstanding amount. 
  1. In the case of damages, including property destruction, soiling, or theft, which result in the temporary exclusion of the Apartment from rental use, RentPlanet Apartments reserves the right to claim compensation from the Guest for lost profits, in particular revenue lost due to the inability to rent out the Apartment. 
  1. The Guest is not responsible for damages which occur as a result of a Force Majeure. They are, however, obliged to attempt minimizing damages resulting from Force Majeure to an extent to which it is possible. 
  1. If the performance of services is found to be contrary to the Agreement, the Guest should file all complaints to RentPlanet Apartments in writing or in electronic form (to the e-mail address: biuro@rentplanet.pl) no later than within 7 days from the date on which the stay ended. 
  1. RentPlanet Apartments investigates the complaint within 14 days from the receipt thereof, which the Guest is informed about in the same written or electronic form. 
  1. If the complaint is rejected, RentPlanet Apartments is obliged to provide a detailed justification of the reasons for rejection in writing or in electronic form. 
  1. Personal items, excluding groceries and hygiene products, left behind in the Apartment by the Guest, will be shipped, at the Guest’s request, to the address specified by the Guest within 1 month from the date of check-out, at the Guest’s cost and risk. If no instruction of shipment is received, RentPlanet Apartments undertakes to store the items left behind by the Guest for a period of 1 month from the check-out date. Such items will be destroyed or handed over to the finder. 
  1. RentPlanet Apartments is not responsible for loss or damage of money, securities, valuables, other items and objects of value, or objects of scientific or artistic value. 
  1. RentPlanet Apartments is not liable for the loss or damage of the Guest’s car or other means of transport of the Guest regardless of whether these vehicles were parked in parking spots belonging to the Apartment or in public parking spots (near the Apartment). 
  1. Guests are required to properly and appropriately secure the Apartment, in particular by carefully closing windows, doors, etc. each time they leave the Apartment. 
  1. Guests are also required to ensure that all taps and faucets in the Apartment are turned off when not in use (especially when leaving the Apartment). A similar situation applies to gas-powered appliances (if applicable). In addition, electrical appliances that are not in use (chargers, appliances brought by Guests, etc.) should also be unplugged, and other electrical appliances (which are Apartment equipment) should be turned off. 
  1. In the event that any damage is identified, the guest agrees to cover its value within 24 hours of receiving the notification and payment link provided by RentPlanet. The total claim amount (the value of the damage together with collection costs) may be subject to debt recovery proceedings and reported to the National Debt Register or other debtor databases, in accordance with applicable laws. 
  1. If payment is not made within the specified deadline, collection costs of up to PLN 150 will be added to the value of the damage. These costs constitute compensation for administrative expenses and actions undertaken to recover the amount due. RentPlanet holds photographic documentation of the apartment prior to the guest’s stay. In the event of any damage, photographic documentation (taken either by RentPlanet or by the guest) may serve as evidence confirming the condition of the apartment. 
  1. Lack of photographic documentation may make it difficult to dispute any claims related to damages or missing items. 

§ 7. Animals

  1. RentPlanet Apartments may allow pets to stay in the apartment upon prior arrangement with the Client. A one-time fee of 250 PLN per pet is charged, regardless of the length of stay. The Client must inform RentPlanet Apartments about the stay with a pet before arrival. Failure to notify about the stay with a pet will result in a fine of 500 PLN. Regardless of the above-mentioned fines, the Guest is fully responsible for any damages caused by the pets that stayed in the apartment. RentPlanet Apartments reserves the right to claim compensation from the Guest for any damages caused under applicable laws and regulations. 

§ 8. Final Provisions 

  1. For the actions performed and Agreements concluded through the Website, the Regulations’ version which is in force upon the date of the action performance or Agreement conclusion applies. 
  1. The Guest accepts and consents to the sending of invoices in electronic form with the use of electronic mail. 
  1. These Regulations come into force on the date of their publishing on the Website. 
  1. A violation of these Regulations constitutes a basis for terminating the Apartment rental Agreement with immediate effect. 
  1. Governing law for matters concerning these Regulations is the law of Poland. 
  1. Provisions of the Civil Code apply to the extent not provided for herein. 
  1. The Guest represents that they have been informed of the content of Article 38.12 of the Consumer Rights Act of 2014, pursuant to which in the case of accommodation services provision agreements, other than those for residential purposes, the consumer does not have the right to withdraw from a remote agreement, which is provided for in Article 27 thereof. 
  1. The Guest’s data are processed in order to conclude and perform the rental Agreement, in order to fulfil RentPlanet Apartments’ statutory obligations, and on the basis of RentPlanet Apartments’ justified interest. The details of the Guest’s data processing are available in the Privacy Policy Policy at: https://noclegi.rentplanet/en/privacy-policy-of-the-website/  The Privacy Policy fulfils the information obligation as per Article 13 of the GDPR, and the Guest confirms having read this information by making a reservation.  
  1. The Guest consents, in accordance with Article 23.1. 1 and 23.1.3 in connection with Article 7.5 of the Act of 29 August 1997 on personal data protection, to the processing, updating, sharing and storing of their personal data in order to perform the Agreement.  
  1. All litigation between RentPlanet Apartments and the Guest will be considered in line with the provisions of Polish law by a competent court in Poland.
